Course Objectives
The course aims to provide a general grounding in private international law as applied in international civil and commercial litigation, focusing primarily on the jurisdiction, recognition and enforcement, and choice of law. The course also aims to provide a general grounding in nationality law and the law of foreigners.
This course will expose students to problem-solving techniques relevant to this sub-discipline. These will include:
- Determining the jurisdiction and the court's ability to hear a particular dispute.
- Determining the law applicable to legal situations.
- Determining the enforcement and recognition of judgments and decisions.
-Determining the conditions of acquiring and loss of Turkish Nationality.
-Determining the basic fundamental rights and obligations of foreigners-esp. within the context of international protection.
Course Content
The purpose of the course is to inform students about the Turkish system of Private International Law. The course addresses the Law of Nationality and the Status of Aliens. The former deals with the legal rules governing the acquisition, loss and proof of nationality and the resolution of conflicts of nationality. The latter comprises the legal principles and rules that determine the rights and duties of foreigners who reside on the territory of a state.
Course Learning Outcomes
On successful completion of this course, students will be able to:
-Analyse the foundational principles of private international law, undertake (self-directed) legal research, and evaluate legal information.
-Apply private international law rules to complex problems and issues, and critique the operation of private international rules from a theoretical perspective.
-Structure and sustain concise and cohesive written arguments for a legal and professional audience.
-Conduct legal research and analysis both independently and cooperatively in an academic environment.
-Analyse the impact of private international law from a comparative and international perspective and in the context of social and cultural diversity.
-Reflect on their abilities to effectively undertake accepted forms of legal reasoning and analysis to articulate in persuasive fashion reasoned solutions to issues arising from such scenarios
