Course Objectives
Aims to provide students with an overview of law and economics in general which is followed by the purposes of competition law and policy; historical background of competition law in the world and the comparative overview of EU and US Competition laws in relation to Turkish Competition law. Also provides a critical assessment of other policies such as energy, telecommunications and specifically dijital economy related topics with repect to competition law.
Major cases related to digital markets and services by allowing and guiding students to research the relevant platform economy related topics, cases and regulations in different jurisdictions.
Course Content
The course intends to overview the basic concepts of competition law such as agreements, decisions and concerted practices of undertakings, monopolies and abuse of dominant power in the market, control of mergers and acquisitions which may affect competition. It covers a comparative introduction of Turkish, European Union and United States competition laws. Throughout the course the legislation and jurisprudence of the European competition law is also analyzed, since the competition law in Turkey is to a great extent in compliance with the European law.
Course Learning Outcomes
By the end of this course, students will be able to:
Identify and explain the fundamental concepts of competition law, including agreements, decisions, and concerted practices of undertakings, monopolies, and abuse of dominant power in the market.
Analyze and compare the key provisions and enforcement mechanisms of competition laws in Turkey, the European Union, and the United States.
Evaluate the impact of mergers and acquisitions on competition and assess the criteria used for their control in different jurisdictions.
Interpret and apply relevant legislation and jurisprudence of European competition law to analyze cases and scenarios related to competition issues.
Demonstrate an understanding of the principles of competition law compliance and enforcement, including the roles of regulatory authorities and the judicial system.
Critically assess the effectiveness and limitations of competition law regimes in addressing anti-competitive practices and promoting market competition.
Synthesize knowledge from different legal systems to develop well-reasoned arguments and recommendations regarding competition law matters in a global context.
